A couple of weeks ago, Bethesda settled a lawsuit with Warner Bros which claimed that WB has plagiarized their Fallout Shelter and created Westworld mobile game. Due to this development, Westworld was already removed from Google Play and the App Store starting from January 15, and everything will shut down on April 16. Those who have the game installed on their devices can still play it until this date 16 and this means that players have until then to spend their in-game currency, however, in-game purchases are no longer possible.
The lawsuit filed by Bethesda in the mid-2018 claimed that Warner Bros. Interactive and Behaviour Interactive ripped off Fallout Shelter and created Westworld. They stated that Westworld is using very similar and the same art style, features and game design as their Fallout Shelter. Westworld was launched in June as a spin-off to the HBO hit TV show starring Evan Rachel Wood and Ed Harris. It is at that time that Bethesda notices the uncanny similarities between the two games and decided to file a lawsuit.
Fallout Shelter and Westworld are both management simulators with similar gameplay mechanics. In Fallout Shelter, you manage vaults and its residents, while in Westworld you manage the park by creating androids and matching them to guests. The lawsuit states that Behaviour Interactive was hired by Bethesda in 2014 on Fallout Shelter and now they used that same code to create Westworld for Warner Bros.
“Behaviour breached its contract with Bethesda and utilized its restricted access to Bethesda’s intellectual property, including Bethesda’s copyrighted code, trade secrets, and other rights, to compress its development timeline, reduce costs, and quickly bring the Westworld mobile game to market, and offer players the widely popular gameplay experience found in Fallout Shelter,” stated the lawsuit.
Although the lawsuit was filed before the Maryland US District Court, the companies settled in December and now we are able to see what is one of the conditions for settlement. There is yet to hear what are the consequences to Behaviour Interactive since they have other games in the development and community is worried how this settlement will affect the company and its future projects.
